Personal Data You Provide: Name, email address, phone number, and password when you register. Business information you provide during onboarding (business name, type, description, target audience, location). Payment information is processed securely by Stripe — we never store your card details.

Usage Data: Pages visited, features used, AI prompts submitted, campaign data, and interaction patterns within the platform.

Device & Technical Data: IP address, browser type, operating system, referring URLs, and timestamps of your visits.

3. Cookies & Tracking Technologies

We use cookies and similar tracking technologies to improve your experience on our platform. These include:

Essential Cookies: Required for login sessions and platform functionality.
Analytics Cookies: Used to understand how users interact with our platform (via Google Analytics).
Marketing Cookies: Used by Meta Pixel and Google Tag Manager to measure ad campaign effectiveness.

4. How We Use Your Information

To create and manage your account and provide our AI marketing services.
To personalize AI-generated content based on your business profile.
To process payments and manage your subscription via Stripe.
To send transactional emails (OTP, welcome, billing) via Brevo.

5. Third-Party Services & API Compliance

We work with trusted third-party APIs to operate our platform. Our use of these APIs strictly adheres to their respective developer policies:

Google API Services: Adsgenix's use and transfer to any other app of information received from Google APIs will adhere strictly to the Google API Services User Data Policy, including the Limited Use requirements. We do not use Google API data to develop, improve, or train generalized AI models.
Meta (Facebook/Instagram/WhatsApp): When you connect Meta, we access your ad account and page to manage campaigns. This is governed by Meta's Platform Policy. We do not sell this data or use it for unauthorized surveillance.
Stripe: Payment processing. Your card data is handled exclusively by Stripe securely.
Brevo (Sendinblue): Used for transactional email delivery.
OpenAI & Anthropic: AI content generation. Prompts may include your business contextual data but are explicitly opted-out of being used to train generalized AI models.

6. Data Deletion Instructions (Meta & Google)

In compliance with Meta and Google API Services User Data Policies, you have the absolute right to request the complete deletion of your data at any time. To delete your data:

Log in to your Adsgenix Dashboard.
Navigate to the Settings tab via the sidebar or top right menu.
Scroll to the bottom of the Settings page.
Click the red Delete Account & Data button.
Confirm your choice. Your personal data, linked Meta/Google tokens, and business profile will be instantly and permanently wiped from our databases.

Alternatively, you can email privacy@adsgenix.com with the subject "Data Deletion Request" and we will manually purge your records within 24 hours.

6b. Data Retention

We retain your personal data for as long as your account is active or as needed to provide you with our services. If you delete your account, we will remove your personal data within 30 days, except where retention is required by law (e.g., financial records for 7 years under Indian tax law).

7. Your Rights (GDPR & Global)

Depending on your location, you may have the following rights:

Right of Access: Request a copy of the personal data we hold about you.
Right to Rectification: Request correction of inaccurate personal data.
Right to Erasure: Request deletion of your personal data ("right to be forgotten").
Right to Restriction: Request that we limit processing of your personal data.
Right to Data Portability: Receive your data in a structured, machine-readable format.
Right to Object: Object to processing based on legitimate interests or for direct marketing.
Right to Withdraw Consent: Withdraw consent at any time where processing is based on consent.

We implement appropriate technical and organizational security measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. These include encrypted data transmission (HTTPS/TLS), hashed passwords using bcrypt, JWT-based authentication, and access controls. However, no method of transmission over the internet is 100% secure.

9. Children's Privacy

Our service is not directed to individuals under the age of 18. We do not knowingly collect personal information from children. If you believe a child has provided us personal data, please contact us at support@adsgenix.com and we will delete it promptly.

10. International Data Transfers

Adsgenix is operated from India. If you are located outside India, your information may be transferred to and processed in India and other countries where our service providers operate (including the United States for AWS, Stripe, and OpenAI). We ensure appropriate safeguards are in place for such transfers.

11. Governing Law

This Privacy Policy is governed by the laws of India, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023 (DPDPA). For users in the European Union, we comply with the General Data Protection Regulation (GDPR). For users in California, we comply with the CCPA.

1. Acceptance of Terms

By accessing or using the Adsgenix platform ("Service"), available at adsgenix.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our Service. These Terms apply to all users, including visitors, registered accounts, and paying subscribers. We reserve the right to update these Terms at any time; continued use constitutes acceptance of updated Terms.

2. Service Description

Adsgenix is an AI-powered marketing platform that provides:

AI-generated social media posts and marketing content
Meta (Facebook/Instagram) and Google Ads campaign management
WhatsApp Business automation and messaging tools
30-day content calendars and marketing roadmaps
Business profile management and audience targeting tools

We act as a tool to assist your marketing efforts. We do not guarantee specific results, revenue, leads, or ad performance outcomes.

3. Account Registration

You must provide accurate, complete, and current information when creating your account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old to use this Service. You may not create an account on behalf of another person without their express consent.

4. Payment Terms

Adsgenix Pro is offered at $49.00 USD per month and Adsgenix Max is offered at $99.00 USD per month, billed monthly. (Both plans include AI generation for Instagram, Facebook, LinkedIn, and Twitter/X).

Billing: Your subscription renews automatically each month on your billing date. Charges are processed via Stripe.
No Refunds: All payments are non-refundable. This includes partial months, unused features, or early cancellation.
Cancellation: You may cancel at any time. Cancellation takes effect at the end of the current billing period. Your access continues until that date.
Failed Payments: If a payment fails, we may suspend your account until payment is resolved. We will notify you before suspension.
Price Changes: We will provide at least 30 days' notice before changing subscription pricing.

5. Meta, Google & WhatsApp API Compliance

By connecting your external accounts (Meta, Google, WhatsApp) to Adsgenix, you agree to their respective terms of service:

Ad Budget Liability: Ad spend is charged directly to your Meta or Google billing accounts — not to Adsgenix. We do not handle or process your ad budget. You are solely responsible for setting and monitoring your ad budgets. We are not liable for accidental overspend or campaign performance.
WhatsApp Business Acceptable Use: You agree to comply with the WhatsApp Business Messaging Policy. You must not use our platform to send spam, unauthorized bulk messaging, or illicit content. Meta reserves the right to suspend WhatsApp numbers that violate their policies, and Adsgenix is not liable for such suspensions.
Meta Advertising Policies: All ad copy and imagery generated via our AI and published to Meta must comply with Meta's Advertising Standards.
Google API Services: Your use of Google integrations indicates acceptance of Google's API Terms of Service.

6. Intellectual Property

Adsgenix IP: All platform code, design, branding, algorithms, and non-user-generated content are the exclusive property of Adsgenix. You may not copy, reproduce, distribute, or create derivative works without explicit written permission.

Your Content: You retain ownership of all business information, ad creatives, and content you upload. By using our Service, you grant Adsgenix a limited, non-exclusive license to use this content solely to provide and improve our services to you. AI-generated content created using your business data is yours to use commercially.

7. Prohibited Uses

You agree not to use the Service to:

Violate any applicable local, national, or international laws or regulations
Create, distribute, or promote illegal, harmful, deceptive, or discriminatory content
Violate Meta's Advertising Policies, Google's Ads policies, or WhatsApp's Business Policy
Engage in spam, phishing, or unauthorized bulk messaging
Attempt to reverse-engineer, hack, or disrupt our platform or servers
Use the platform to infringe on any third party's intellectual property rights
Misrepresent your identity or business information
Resell or sublicense access to Adsgenix without written permission

Violation of these prohibitions may result in immediate account termination without refund.

8. Account Termination

By You: You may cancel your subscription at any time from your account settings. Your account and data may be deleted 30 days after cancellation.

By Adsgenix: We reserve the right to suspend or terminate your account immediately, without prior notice or refund, if you violate these Terms, engage in fraudulent activity, or if required by law. We may also terminate accounts that are inactive for 12+ consecutive months.

9. Limitation of Liability

To the fullest extent permitted by law, Adsgenix and its founders, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, profits, data, or business opportunities, arising from your use of the Service. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranty of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranties regarding the accuracy or completeness of AI-generated content.

11. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of India. We encourage resolving disputes informally first — contact us at support@adsgenix.com before initiating formal proceedings.

Do I need a Meta or Google account? +

For running ads, yes. You'll need your own Meta Business account and/or Google Ads account. Adsgenix connects to these accounts to create and manage campaigns on your behalf. Ad spend is billed directly to your ad accounts.

Can I get a refund? +

Adsgenix subscriptions are non-refundable. You can cancel at any time and continue using the platform until the end of your current billing period.
